Judicial Branch

An important purpose of our government is to protect the rights of its citizens. When the Constitution was written, our founding fathers relied heavily on the beliefs of philosophers such as Locke and Montesquieu. One important concept that was used in the formation of our government was the idea of separation of power. Therefore, there needed to be a branch of government that was equal to the executive and legislative branches and could rule on whether the actions of those branches violated the Constitution. In addition, Congress was given the power to determine the size, structure, and amount of lower federal courts, which checked the power of the judicial branch.

"The judicial power of the United States shall be vested in one Supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish." -Article 3 of the The United States Constitution
